Reasons for Refusal
• On December 15, 2016, Calgary Planning Commission approved a development permit for a
Temporary Use: Dry Waste Disposal and Treatment Facility (DP2015-1631) for the subject site.
That approval noted that no waste materials shall be disposed of at the landfill after December
31, 2024 and that the landfill will close no later than June 30, 2025. The DP also included specific
conditions relating to maximum geodetic height and extent of the landfill.
• On October 24, 2024, the applicant submitted DP2024-07600 which proposes a new Temporary
Use: Dry Waste Disposal and Treatment Facility (a continuation of the use approved with DP2015-
1631). Since the initial submission, the City has received incomplete or inaccurate development
permit plans and information.
• The City has yet to receive plans which accurately indicate the current height and extents of the
landfill despite repeated requests (via. Detailed Review 1 issued 2024 December 18 as well as
through email correspondence dated 2025 January 7 and 9, and via in person applicant meeting
2025 January 22).
• ECCO, in response to enforcement action taken by the City with regards to DP2015-1631, provided
more fulsome information on January 17, 2025; however, that information demonstrates the site
is currently in contravention of the current development approval, DP2015-1631. Specifically,
DP2015-1631 imposes a 1062.00 metre maximum geodetic height of waste and the geodetics
provided by the ECCO to the city on January 17, 2025, confirm that the landfill is at or exceeds
1062.00 metres (as approved by the province) throughout the site.
• The City has also completed independent survey work which corroborates the determination that
the landfill is at, or exceeds, the maximum height.
• DP2024-07600 would replace DP2015-1631 save for the expiration dates noted in that DP.
• The City does not support the issuance of this development permit as the site is currently not in
compliance with its current approval (DP2015-1631). The City does not support an increase in the
height or maximum extent limitations for the landfill. The 1062.00 metre limitation was
determined appropriate after thorough review and consideration of information provided by the
applicant, as well as ECCO’s provincial approvals in place at the time of application submission.
• Relaxations to ss. 1015(3) and (4) of Land Use Bylaw 1P2007 are not supported.
• Statutory Policy does not state the landfill may continue to operate in perpetuity. Per
Administration’s report to Calgary Planning Commission 2016 December 15, it is intended that no
waste materials shall be disposed of at the landfill after 2024 December 31 and that the landfill
will close no later than 2025 June 30. Administration’s intention has not changed.
